§1. General provisions

 

  • These regulations define the rules for using the online store operated at the address: www.puffmuff.pl by:
    • Katarzyna Mirek Bio-Group based in: Małopolska 1 lok. 63, 35-620 Rzeszów, Podkarpackie Voivodeship, Poland, NIP: 7941828769, REGON: 7941828769, email address: biuro@puffmuff.pl, tel.: +48 509040259, – hereinafter referred to as " Seller".
  • The online store conducts retail sales of ski hoods/buffs and winter accessories for children and youth ("Goods") via the Internet.

  • A Customer of the Store can be:
    • a consumer within the meaning of Article 22¹ of the Civil Code,
    • a natural person conducting business activity purchasing unrelated to this activity ("entrepreneur on consumer rights"),
    • an entrepreneur within the meaning of the Civil Code.
  • The store is directed to adults. Purchases for children and youth are made by their parents or legal guardians.

  • The regulations are made available free of charge on the website www.puffmuff.pl in a manner that allows its acquisition, reproduction, and preservation by the Customer.

  • For matters not regulated in the Regulations, the following apply in particular: the Consumer Rights Act, the Act on the Provision of Electronic Services, the Act on Information on Prices of Goods and Services, the Civil Code, and other absolutely binding provisions of Polish law.

 

§2. Definitions

 

The terms used in the Regulations mean:

  • Store – the Seller's online store available at the address www.puffmuff.pl.

  • Seller – the entity specified in §1 sec. 1.

  • Customer – the entity specified in §1 sec. 3.

  • User – any person using the Store's website.

  • Order – the Customer's declaration of intent aimed at concluding a Distance Sales Agreement for Goods with the Seller, made using the order form (without registering an account).

  • Sales Agreement – the sales agreement for Goods concluded at a distance via the Store.

  • Working Days – days from Monday to Friday excluding statutory holidays in Poland.

  • Consumer – Customer defined in §1 sec. 3 point 1; applies accordingly to the "entrepreneur on consumer rights."

 

§3. Technical requirements

 

  • To use the Store, it is necessary to have:
    • a device with internet access,
    • an up-to-date web browser,
    • an active email account,
    • enabled cookie support (details in the Privacy Policy).
  • The User is obliged to use the Store in a manner consistent with the law, good customs, and the Regulations.

 

§4. Rules for using the Store (without account registration)

 

  • The Store does not require user account registration.

  • Placing orders is done through the order form available on the Store's website.

  • The Customer is obliged to provide true, complete, and current data necessary for the Order fulfillment (identification data, delivery address, email, phone, invoice data – if applicable).

  • It is prohibited to provide illegal content (e.g., offensive, violating the rights of third parties).

 

§5. Information about Goods and prices

 

  • Descriptions of Goods (including indication of suitability for children/youth and sizing) serve to facilitate selection and constitute an invitation to conclude a contract within the meaning of Article 71 of the Civil Code, and not an offer.

  • Prices of Goods:
    • are stated in Polish zlotys (PLN) and include VAT,
    • do not include delivery costs, which are indicated separately before placing the Order,
    • in the case of promotions, include information about the lowest price from 30 days before the discount (if required by law).
    • The Seller reserves the right to change prices, introduce new Goods, conduct and cancel promotions without infringing the rights of Customers who have already placed orders.

 

§6. Placing Orders

 

  • The Customer can place Orders 24 hours a day, 7 days a week.

  • The procedure for placing an Order:
    • selecting the Goods (e.g., model/color of the hood, size),
    • adding the Goods to the cart,
    • proceeding to the order form,
    • completing the data required for Order fulfillment,
    • selecting the delivery method,
    • selecting the payment method,
    • accepting the Regulations and Privacy Policy,
    • clicking the button type "I buy and pay"
  • Before placing the Order, the Customer receives a summary including, among others: selected Goods, total gross price, delivery cost, selected payment method.

  • Upon placing an Order, the Customer receives a confirmation of Order acceptance at the provided email address. The Agreement of sale is concluded upon receipt of the confirmation.

 

§7. Payments

 

  • Available payment methods:
    • traditional bank transfer to account: 80 10501445 1000 0097 2895 4463,
    • online payments (e.g. BLIK, fast transfers) via the payment operator: ING BANK ŚLĄSKI,

§8. Delivery

 

  • Delivery takes place in the territory: Poland, Slovakia, Czech Republic.

  • Delivery methods:
    • courier: InPost,
    • parcel lockers / pickup points: InPost,
    • personal pickup: Przyjaźni Polsko-Węgierskiej 6, 30-644 Kraków
  • The cost of delivery depends on the chosen method and is visible during the Order placement.

  • Estimated delivery time: 3-7 working days from payment confirmation (or contract conclusion in the case of cash on delivery).

  • It is recommended that the Customer checks the condition of the shipment upon receipt. In case of damage, it is advisable to prepare a damage report and contact the Seller.

 

§9. Safety and use of Goods

 

  • Ski neck warmers and winter accessories for children/youth should be used according to their intended purpose and under adult supervision.

  • The Seller recommends:
    • adjusting the size of products to the child's age and height,
    • not tying neck warmers/accessories in a way that could pose a risk of choking or snagging (e.g. at the ski lift),
    • familiarizing oneself with the washing and maintenance instructions (if attached).

 

§10. Right to withdraw from the contract (returns)

 

  • The Customer – Consumer (or entrepreneur on consumer rights) has the right to withdraw from the distance sale Agreement within 14 days without giving a reason.

  • The deadline runs from the day the Customer or a third party indicated by them, other than the carrier, takes possession of the Goods.

  • To exercise the right of withdrawal, the Customer submits a statement to the Seller:

    • by email: biuro@puffmuff.pl, or

    • in writing to the address: Małopolska 1 lok. 63, 35-620 Rzeszów

  • The Customer may use the template for the withdrawal form (attached to the Regulations or the Consumer Rights Act).

  • The Customer is obliged to return the Goods to the address: Przyjaźni Polsko-Węgierskiej 6/134, 30-644 Kraków no later than within 14 days from the day they withdrew from the contract.

  • The Customer bears the direct costs of returning the Goods.
  • Due to the nature of the Goods (products worn close to the face, mouth, and nose), the Seller informs that with respect to neck warmers/buffs delivered in sealed packaging, upon opening, the right to withdraw may not apply for hygiene reasons – as provided in Article 38 of the Consumer Rights Act. Detailed rules are described in the Returns and Complaints Regulations.

  • Detailed rules for withdrawal from the contract are specified in the Returns and Complaints Regulations.

 

§11. Complaints (Goods defects)

 

  • The Seller is obliged to deliver Goods free from defects.

  • A complaint can be submitted:
    • by email: biuro@puffmuff.pl,
    • in writing to the address: Małopolska 1 lok. 63, 35-620 Rzeszów
  • It is recommended to provide in the complaint:
    • Customer's details,
    • order number,
    • description of the defect and the date it was discovered,
    • Customer's request (repair, replacement, price reduction, withdrawal).
  • The Seller will respond to the complaint within 14 days of receipt.

  • Detailed rules for complaints are specified in the Returns and Complaints Regulations.

 

§12. Personal data and cookies

 

  • The administrator of personal data of Customers is the Seller.

  • The principles of processing personal data and using cookies are specified in the Privacy Policy available at https://puffmuff.pl/polityka-prywatnosci.

 

§13. Final provisions

 

  • The Seller reserves the right to change the Regulations for important legal or organizational reasons.

  • Customers will be informed of the change in the Regulations by publishing a new version on the Store's website.

  • For Orders placed before the change in the Regulations, the Regulations in effect on the date of placing the Order apply.

  • Disputes between the Seller and the Consumer are resolved by the competent common court.
